Part A: Terms and Conditions

By accessing the Grubdeli mobile application ("App") or website, you agree to these legally binding Terms.

1. Services Provided

Grubdeli is a marketplace platform connecting users with local Vendors (Pharmacies, Restaurants, Supermarkets, Artisans, and Couriers).

Note: Grubdeli is a facilitator. We do not manufacture or prepare the products. The quality and safety of goods are the responsibility of the specific Vendor.

2. User Accounts

  • You must be at least 18 years old (or the age of majority in Alberta) to create an account.

  • You are responsible for maintaining the security of your login credentials.

  • Grubdeli reserves the right to suspend accounts for fraudulent activity or violation of conduct rules.

3. Orders and Payments

  • Pricing: Prices are set by Vendors and include applicable taxes (GST) and delivery fees.

  • Payment: All transactions are processed through secure third-party partners (e.g., Stripe).

  • Pharmacy Orders: All prescription orders must comply with Alberta College of Pharmacy standards. Proof of ID may be required upon delivery.

4. Delivery & Parcels

  • Estimates: Delivery times are estimates. We are not liable for delays due to traffic, weather, or Vendor preparation times.

  • Packages: For the Parcel Delivery Module, users must not send prohibited items (illegal substances, weapons, or hazardous materials).

5. Limitation of Liability

Grubdeli Canada Inc. is not liable for indirect, incidental, or punitive damages arising from the use of the service. Our total liability is limited to the amount paid for the specific order in dispute.

Part B: Privacy Policy

We are committed to protecting your data under Alberta’s Personal Information Protection Act (PIPA).

1. Information We Collect

  • Customers: Name, email, phone, delivery address, and payment tokens.

  • Riders: ID verification, vehicle details, and real-time GPS (only during active deliveries).

  • Vendors: Business registration and payout financial data.

2. Purpose of Collection

We collect data solely for Reasonable Business Purposes:

  • Fulfillment: To get your order from point A to point B.

  • Safety: To verify Rider backgrounds and ensure secure transactions.

  • Communication: To send order updates and support responses.

3. Data Sharing & Security

  • No Sale of Data: We do not sell your data. We only share your address with the Rider assigned to your delivery and your order details with the Vendor.

  • Security: We use SSL/TLS encryption for all data. While we use global servers (like AWS), all data handling complies with Canadian privacy standards.

4. Your Rights

You have the right to access your personal information, request corrections, or withdraw consent at any time by contacting our Privacy Officer at the details listed above.

Part C: Governing Law

These Terms and the Privacy Policy are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Calgary, Alberta.

 

Rider Background & GPS Consent

1. Background Screening I, the undersigned applicant, hereby authorize Grubdeli Canada Inc. to conduct a comprehensive background check as part of my application to become a Rider. This may include, but is not limited to:

  • Criminal Record Check: A search of the RCMP’s Canadian Police Information Centre (CPIC) and local police databases.

  • Driver’s Abstract: A review of my 3-year or 5-year Alberta driving history (convictions, demerits, and license status).

  • Work Eligibility: Verification of my legal right to work in Canada (Citizenship, PR, or Work Permit).

2. Real-Time GPS Tracking To ensure the safety of the marketplace and provide accurate delivery estimates to Customers and Vendors, I consent to Grubdeli collecting my real-time location data (GPS) via the Grubdeli Rider App.

  • Active Status Only: Tracking only occurs when I am "Online" or during an active delivery shift.

  • Purpose: This data is used for route optimization, providing delivery proof, and emergency safety support.

  • Transparency: I understand I can disable location services in my phone settings, but doing so will prevent me from receiving delivery requests.

3. Insurance & Vehicle Compliance I confirm that my vehicle is registered in the Province of Alberta and is covered by an active insurance policy that permits "Hire and Reward" or "Commercial" use for delivery services. I agree to notify Grubdeli immediately if my insurance or license status changes.
